Identification of Processing – How do we collect personal data ?

In accordance with current data protection regulations, particularly the Law modernizing legislative provisions on the protection of personal information (Law 25),

Infrasco collects personal data in its possession when the user :

  • Completes forms on the website;
  • Sends an email or communicates by phone.

Personal Data Collected – What personal data do we collect ?

Infrasco collects information when you visit their website, primarily through completing online forms.

The following data is collected :

  • Address

Generally, when personal data is required to use a service or access specific content, its provision will not be obligatory, except where it is specifically indicated as necessary for the provision of the service. In such cases, the user can freely choose not to register and/or not to contract the services.

The user declares and guarantees that all data provided by them is true and accurate and commits to keeping it up to date. Changes can be communicated to the Data Protection Officer or to the address provided in the Contact section above.

Additionally, the user acknowledges that the data required by Infrasco is necessary, adequate, and not excessive to fulfill the stated purposes, which would be impossible to achieve without the provision of such data.

Any false or inaccurate statements resulting from the provided information and data, as well as any harm caused by this information, will be the user’s responsibility.

Purpose – What are the personal data we collect used for ?

The personal data requested from the user will be used for the following purposes :

In the case of service contracts offered on the website, to create and maintain the business relationship and perform activities and provide Infrasco services (including, but not limited to, service management, administration, provision, and improvement).

Conduct surveys or organize contests.

Customize the user experience, enhancing our ability to meet their needs.

Improve the Infrasco website and service offerings, relying on Infrasco’s legitimate interest in continuously improving its products and services.

Process transactions and comply with legal obligations to which Infrasco is subject, such as tax obligations.

How do we use your Information ?

We will use the information we collect about you for the following purposes :

Consent

By providing personal data to Infrasco, the user declares full and unreserved consent to the processing of this data by Infrasco. The user hereby grants their free, express, and informed consent to Infrasco to use the collected data for the purposes outlined in the Purpose section above and for their incorporation into third-party databases/applications used by Infrasco.

Infrasco legitimately processes the user’s data through: (i) the conclusion of a service contract with Infrasco by the user, in accordance with the terms and conditions made available to the user upon completion of the service request form (prior to any hiring) and which the user (after reviewing), if in agreement, may accept by checking the designated box included for this purpose; and (ii) the user’s free, informed, and unequivocal consent, given after reviewing this privacy policy where Infrasco informs about the processing it will perform with your data, and if you agree, by checking the box provided for this purpose in the service request form. Data processing not covered by one of the aforementioned legal bases will be carried out by Infrasco if it deems it necessary to protect a legitimate interest, and only if it does not infringe on the user’s fundamental rights and freedoms.

Expiration – How long do we retain your data ?

Data will be destroyed or archived when it is no longer strictly necessary or relevant for the purposes detailed in the Purpose section above. Specifically, personal data will be retained as long as the business relationship is in force (and as long as the user has not previously requested its deletion) and during the period in which obligations, compensations, and/or liabilities may arise in the context of the business relationship or for the services provided. Infrasco informs that it will keep essential information to identify the source of the stored data for the duration of the client relationship with Infrasco and/or the revocation of the user’s consent in accordance with the information in the Consent section of this privacy policy and/or for the duration required by applicable law.

Confidentiality / Assignment / International transfer – Do we disclose data to third parties ?

Infrasco will keep the user’s personal data collected privately and confidentially, using it only for the purposes established in the Purpose section above. Infrasco requires the signing of confidentiality and personal data processing agreements by its employees and third parties providing services that access the contents of the databases (or includes such obligations in the service agreements it signs with such providers as indicated in the following paragraph).

The user’s personal data collected by Infrasco will not be transferred, sold, exchanged, transmitted, and/or communicated to third parties outside of Infrasco without the user’s consent, except as required by law and/or for the purpose of providing services to the user. This does not include certain employees and service providers that enable Infrasco to keep the site running, to comply with the purposes set out in the Purpose section above, and/or to provide services to the user, who have undertaken the obligation to maintain the confidentiality of the provided data and commit to complying with applicable data protection regulations at the time of hiring. Contracts with service providers specify the purpose, scope, content, duration, nature, and purpose of data processing, the type of personal data, the categories of data owners, and the obligations and responsibilities of Infrasco and contractual third parties.

In particular: Infrasco may share the personal information provided with parent companies, subsidiaries, affiliated companies, related companies, and/or intermediaries related to Infrasco.

Infrasco may share certain personal information provided by the user internally within Infrasco, with specific departments such as administration, marketing, or IT.

Finally, the user should be aware that Infrasco may (and reserves the right to) disclose their information in the following cases: (i) if required by a judicial or administrative authority; (ii) if necessary to exercise your rights under Infrasco’s terms and conditions and this privacy policy; (iii) if required to comply with the law; (iv) if the data could be useful for protecting the rights of third parties; (v) when useful for the protection of the rights, property, or safety of Infrasco, its controllers, its subsidiaries, its affiliates, its officers, its employees, users, or the general public; and (vi) when there are legitimate reasons concerning public safety, national defense, or public health.

Security – How do we ensure data security ?

Infrasco declares its intention to adopt the necessary technical and organizational measures to ensure the security, integrity, and confidentiality of data in accordance with the provisions of the Law modernizing legislative provisions on the protection of personal information (Law 25) to prevent their alteration, loss, unauthorized access, or processing.

Infrasco does not guarantee absolute privacy in the use of the site, as it cannot be excluded that unauthorized third parties may become aware of it. The user acknowledges that existing technical security measures are not impenetrable and that even with all reasonable security precautions, information can be subject to manipulation, destruction, and/or loss. In case of detection of a security incident involving a significant risk to the data owner, this event will be promptly reported to the competent supervisory authority, as well as the corrective and remedial measures implemented and/or to be implemented.

Infrasco is not responsible for the loss or deletion of data by users. Likewise, Infrasco accepts no liability for potential damage caused by computer viruses.

Finally, the user must also take measures to protect their information. Infrasco strongly advises you to take all precautions to protect your personal information when you are on the Internet. At the very least, you are advised to change your password periodically, using a combination of letters and numbers, and ensure that you are using a secure browser.

Owner’s data rights and procedures for exercising them – What rights do I have as the data owner ?

The user, as the owner of the data, can exercise at any time the rights of access, rectification, cancellation, opposition, processing limitation, portability, confidentiality, and deletion regarding their personal data, in accordance with the provisions of the Law modernizing legislative provisions on the protection of personal information (Law 25). These rights can be exercised by the user themselves by email to info@infrasco.com, or by written communication addressed to the data protection officer at the following address : info@infrasco.com, or by any of the means provided for by the applicable regulations mentioned above. Infrasco may request the data necessary to validate the data owner’s identity.

The deletion of certain data will not be carried out when it could cause harm to the rights or legitimate interests of third parties, or when there is a legal obligation to retain the data.

Training – Do we conduct training ?

Infrasco’s staff, whose duties are related to the processing of personal data, get trained to ensure better protection of personal data and the rights of their owners.

Links to Third Parties – Does our website contain links to other websites ?

The site may contain links to third-party websites, with or without advertising content, whose privacy policies are unrelated to Infrasco. Linked sites are not affiliated with Infrasco, and their existence does not imply any suggestion, invitation, or recommendation for visiting the destination sites or any link or association between Infrasco and these sites. Infrasco is not responsible or liable for the content, use, and activities of these linked sites, nor for any actual or potential, material or moral, direct or indirect damages suffered by users derived from the information contained in these sites or the relationships that users may establish with third parties whose services have been published on the site. Nevertheless, any feedback regarding these linked sites will be useful to Infrasco to improve services and/or ensure the site’s integrity. Cookies – Do we use Cookies ?

When the user enters the site, Infrasco may store information on their computer in the form of a “cookie” or similar file. The site uses cookies to (i) track advertising, (ii) collect data on site traffic, and (iii) enhance the user experience while using the site.
